What Data We Collect and How

Standard Identifying Information. Standard identifying information is information that identifies you, such as your name, mailing address, telephone number, email address, employer, or business name. We will ask you to provide standard identifying information when you request assistance on our Site, subscribe to our mailing lists, request exportation of your plans from our PDF maker feature, contact us with a question or concern, or participate in other activities when you visit a Site.

Commercial Information. When you use our PDF maker feature to compile plans, we collect records of content viewed and considered, or other project or consuming histories or tendencies. We will also collect your email address when you ask us to send you a record of your compilations from PDF maker.

Sensitive Personal Information. We will only process sensitive personal information where it is necessary and where you give consent for the purposes of (i) providing our Site or those services you request; and (ii) carrying out our legal obligations or exercising specific rights as permitted by law. The definition of “sensitive personal information” depends on jurisdiction and where you reside, but IP addresses and geolocation data are examples of what may be considered sensitive in some locations. Please also review the section on Your Privacy Rights and Preferences below.

Information from Your Device. Information from and about the device or browser you use when you visit our Site, including IP address, identifiers, type, browser type and language, operating system, and location (if enabled). We may also determine what technology is available through your browser to serve you the most appropriate version of our Site.

Usage Data. We may also collect information about how your device or browser interacts with our Site, such as the content you access, pages and sites visited before and after you reach the services and content offered through our Site, the date and time of your use, the amount of time spent on the Site, and other actions taken through use of our Site. We use data analytics with this Usage Data to better understand your use of the Site in order to improve the Site and services offered. Internet or Other Network Activity. We collect information about your internet activity, including browsing or search history, interactions with our Site, or marketing and advertising. We collect information from Google Analytics or other third-party data aggregators; we may use such information to supplement your information maintained by us. Other Applications. If you access our Site through a third-party application, such as native mobile apps like IOS and Android or social networking sites (“SNS”) such as Instagram, X formerly known as Twitter, or Facebook, we may collect information about you from that third-party application that you have made public via your privacy settings. This may include: your name, your SNS user ID, location, sex, birth date, email, profile picture, and your contacts on the SNS.

Why Do We Collect This Data?

We use your information for the following purposes:

• Allow you to use our Site and provide you with our services, including the PDF maker feature.
• To communicate with you and provide support.
• To send you marketing materials and/or promotions when you subscribe to our mailing list.
• For analytics, research, and Site improvement purposes.
• To ensure the security and integrity of our Site.
• To comply with any applicable law and/or regulations and our contractual obligations.
• For safeguarding and defending our vital interests and exercising any rights, asserting any claims, and any other lawful business purpose.

Access to our Site and Services. BNIM uses your information to operate, improve, maintain, and personalize our Site and provide you with our services. Our PDF maker feature allows you to compile plans and materials for your review and evaluation. Upon your request, we will use your email address to send you a record of your complications from our PDF maker feature.

Communication and Support. BNIM uses your information to communicate with you and provide support when you request it.

Marketing and Promotions. With your consent, BNIM uses your information to market its services, which may include contacting you by phone, email, postal mail, or SMS with information about news, offers, products, promotions, events, and/or services that might be of interest to you, as permitted by applicable law. This may include various usage data to send marketing communications that are personalized. Analytics, Research, and Product Development. BNIM is continuously trying to improve our Site and services as well as your experience by using your information for these business purposes, including:

• Monitoring and measuring your use of our Site and services and conducting research to understand how they are being used and how they can be improved. BNIM uses Google Analytics to perform these functions.
• In some cases, information may be deidentified, compiled, and analyzed on an aggregate basis, we may share this aggregate data with our affiliates, agents, service providers, and other third parties with whom we do business. Examples include, but is not limited to, usage, performance, product, and services. This aggregate information does not identify you personally.

Security and Integrity of Our Site and Services. Providing a safe and secure environment is key to providing a responsible website and we do this by using your information to:

• Detect and combat any abuse or any harmful activity, fraud, spam, and illegal activity affecting our Site or services such as using personal identifiers, data usage, and other types of data to detect fraud, authentication, or other harmful activity;
• Monitor content on the Site;
• Prevention and detection of crime; and
• Protect the health and safety of users using our Site and services.

Compliance. We use information to investigate disputes or claims related to our Site and services. We may use the IP address associated with your device to determine your general location in order to comply with governing privacy regulations and serve you necessary notifications and/or consent mechanisms.

We may also use information in the performance of our contractual obligations with service providers we contract with to provide you certain services in connection with your use of our Site.

Who We Share Your Information With

We do not rent or sell your personal information. However, we may share your personal information to the following categories of recipients.

Service Providers. BNIM may share personal information with trusted service providers, such as technology partners, analytics providers, cloud storage providers, or other providers that need access to your information to provide operational or other support services while you use our Site. We may disclose de-identified, aggregated, and/or anonymous information to our service providers for analytics purposes.

Business Partners. BNIM may share personal information with our business partners who otherwise process personal information for purposes described in this Privacy Policy, such as advertising and marketing partners, research partners, and consultants, or who are otherwise disclosed to you when we collect your personal information.

Government Agencies, Regulators, Law Enforcement, and Courts. We may share your personal information with competent law enforcement bodies, regulators, our insurers, external legal advisors, government agencies, courts, or other third parties where we believe disclosure is necessary to: (i) comply with applicable law; (ii) exercise, establish or defend our legal rights; (iii) protect your rights or vital interests or those of any other person; or (iv) detect, prevent, or otherwise address security, fraud, or technical issues.

Potential Buyers (and their agents and advisors). We may share your personal information with actual or potential buyers (and their agents and advisors) in connection with any actual or proposed purchase, merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of BNIM assets or transition of service to another provider. In such a case, we will inform the buyer or transferee that it must use your personal information only for the purposes disclosed in this Privacy Policy.

Deidentified Data. We may disclose deidentified information about our Site users and information that does not identify any individual or device, without restriction.

Cookies, Analytics, and Tracking Technologies

We may use cookies, analytics, and tracking technologies such as Google Analytics.

• Cookies. Cookies are information files that our Site may send to your computer to provide extended functionality and to allow us to collect anonymous data to track usage patterns, monitor activity, and administer the Site. Cookies let us “remember” information about your preferences and allow you to move about our Site without reintroducing yourself. We may use cookies for a number of purposes, such as tracking usage patterns on the Site and measuring the effectiveness of the Site.
• IP Address Tracking. An IP address is a number that is assigned to your computer or device when you are on the Internet. When you request pages from our Site, our servers log your IP address.
• Global Tracking Signals. The Global Privacy Control (“GPC”) is a user-enabled privacy signal that enables you to opt-out of the sale of your personal data. The GPC signal is a browser extension that communicates your preference to opt-out of the sale of your personal information. BNIM does not sell your personal data; however, our Site honors GPC signals that you activate.

You may disable cookies, receive a warning before a cookie is placed on your computer, and erase cookies from your hard drive through use of options or preferences menus in your browser. It is possible, however, that some parts of our Site will not operate correctly if you disable the cookie feature. You should consult with your browser’s provider/manufacturer if you have any questions regarding disabling cookies.

Privacy of Children

Our Site and related services are not intended for children under 16 years of age. No one under the age of 16 may provide any personal information on our Site. We do not knowingly collect personal information from children under 16. If you are under 16, do not (1) use or provide any information on our Site, or through any of the features/functionality of our Site; (2) use any of the interactive, transmittal, or public comment features that may be available on our Site; or (3) provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or username you may use.

If we learn that we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information.

Privacy Rights and Preferences

Your Privacy Rights

BNIM respects your privacy rights and choices. In certain instances, we give you control over the personal information we collect about you, to ensure it is accurate and reflects your preferences. Users of our Site have the following privacy rights:

1. Right to Know. You have a right to know the following information for the twelve- (12) month period preceding your request:
• The categories of personal information we have collected about or from you;
• The categories of sources from which we collected your personal information;
• Our business or commercial purpose for collecting or sharing your personal information;
• The categories of third parties with whom we have shared your personal information;
• The specific pieces of your personal information we have collected; and
• If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
o Sales, identifying the personal information categories that each category of recipient purchased; and
o Disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

2. Access and Data Portability. You have the right to verify whether or not your data is being processed by BNIM and then gain access to the data. You also have the right to obtain an electronic copy of your data and transfer it to a third party.

3. Correction. You have the right to request that we correct inaccurate personal information that we maintain about you.

4. Deletion. You have the right to request that we delete your personal information at any time. Subject to certain exceptions, including verification of your identity, authorization, and fulfillment of your request, we will delete your information if you make such a request. After honoring your deletion request, we may retain personal information that is necessary for us to comply with our legal obligations or that is not otherwise subject to deletion under applicable law.

5. Appeal. You may have the right to appeal our denial of your request to access, correct, or delete your personal information.

6. Opt Out of Sales, Shares, and Targeted Advertising. You have the right to opt out of the “sale” or “sharing” of your personal information, as well as the use of your information for “targeted advertising,” as those terms are defined under applicable privacy laws. However, at this time, we do not “sell” or “share” your information or engage in cross-context behavioral advertising.

7. Limit Use and Disclosure of Sensitive Information. You have the right to direct BNIM to limit our use of sensitive personal information to that use which is necessary to perform the services you request from time-to-time and for other business purposes authorized by applicable privacy laws.

8. Anti-Discrimination. At times, providing your personal information may be necessary for us to provide the services you request, such as sending you the compilations from PDF maker, responding to your inquiries and feedback, or adding you to our mailing list. In the above referenced circumstances, refusal to provide your personal information would make it impossible for us to perform the contract or to provide the requested services or information as above specified.

Providing your personal information for survey or other marketing purposes, as above specified, is optional. Refusal to provide your personal information for these purposes will not have any impact on the performance of our services listed in the preceding paragraph. When required under applicable data protection laws, we will collect your prior consent before processing your personal data for these other purposes.

Please note, however, that the aforementioned rights do not always apply and there are certain exceptions to them.

Please also be advised that we continue to maintain some of your personal data when permitted by law, and that such information has not been deleted. For example, we retain your personal information where it is necessary for us to:

• Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or implied warranty in accordance with laws, provide a product or service that you have requested, or reasonably anticipated within the context of our ongoing business relationship, or otherwise perform a contract between us;

• Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for that activity;

• Debug to identify and repair errors that impair the functionality of our Site or services; and

• Comply with a legal obligation, existing warrant, or litigation hold.

We will confirm your identity and authorization before acting on your requests. We may not be able to respond to your request or provide you with personal information if we cannot verify your identity or the authority to make the request on someone else’s behalf.

Your Preferences

You may also change or update your preferences at any time.

Consent. If we have collected and processed your personal information with your consent (including any sensitive or special category data), then you can withdraw your consent at any time by contacting us using the details provided under How To Contact Us below. Please note, such withdrawal will not affect the lawfulness of the processing prior to your withdrawal.

Direct Marketing. We may send marketing communications for purposes disclosed to you in this Privacy Policy and, where required by applicable law, with your consent. You can unsubscribe from direct marketing at any time by following the instructions below or by contacting us using the details provided under the How To Contact Us. We will process your request within a reasonable time after receipt, in accordance with applicable laws. Unsubscribe options are provided in electronic marketing communications as required by applicable law.

Email. You can unsubscribe from email communications at any time. To stop receiving our promotional emails, follow the unsubscribe instructions in the email messages you receive from us. For other options, review the How To Contact Us section below. We will process your request as soon as practicable after receipt, in accordance with applicable laws. Note that you will continue to receive transaction-related emails regarding products or services you have requested. We may also send you certain non-promotional communications regarding BNIM and our services and, to the extent permitted by law, you will not be able to opt-out of those communications (e.g., communications regarding updates to our policies and practices for using our Site and services).

SMS Messaging and Marketing Related Texts. If you opt in to receiving BNIM text messages, you will receive text messages from BNIM marketing, including recurring automated promotional and personalized marketing text messages from BNIM at the cell number used when signing up. Consent to text message is not a requirement to use our services. To opt-out of receiving BNIM text messages, text STOP to the number from which you received the message. We will send you one final message to confirm that you have been unsubscribed, and will process your request within a reasonable time after receipt, in accordance with applicable laws. Updating your Personal Information

You can update your personal information by contacting us using the details provided under How To Contact Us below. However, do NOT send Social Security numbers or other sensitive information to us via unencrypted email.

How Do We Store and Protect Your Data

BNIM retains personal information we collect or receive as described in this Privacy Policy for the purpose(s) for which it was collected and to provide our services to you, communicate with you, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws. For example, we keep your email address for as long as you subscribe to our mailing list.

To determine the appropriate retention period for your personal information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of your information, the purposes for which we process your information, and the applicable legal requirements. When we no longer need your personal information for a business purpose, or are no longer required to retain the personal information as described above, we will destroy, erase, or de-identify it. However, legal requirements may require us to retain some or all of the personal information we hold for a longer period of time even after our business purpose or need expires.

Transfer of Information to the United States

Our Site is operated in the United States. If you reside outside of the United States, please be aware that any information you provide to us will be transferred to and processed in the United States.
